Judiciary's Observations Spark Calls for Codavaland Autonomy

Madikeri: The recent landmark judgment by the Supreme Court of India regarding the abrogation of Article 370 in Jammu and Kashmir has reignited calls for the establishment of Codavaland, a region in Southwestern India, as a geo-political autonomous entity, states Codava National Council(CNC) in a release. 


“The judgment, delivered on December 11, 2023, has drawn attention to the historical and administrative significance of Codavaland, the erstwhile 'C' State of Coorg, which reigned until 1956,” CNC president NU Nachappa said. 


The Constitution bench of the Supreme Court, headed by Chief Justice of India D.Y Chandrachud, acknowledged Codavaland's unique politico-administrative identity, emphasizing its economic viability and capability to administer itself without dependence on the central government.


Mr Nachappa, has submitted a memorandum to various government officials, including Prime Minister Narendra Modi, Union Home Minister Amit Shah, and the Secretary-General of the United Nations, Antonio Guterres. The memorandum urges the carving out of Codavaland autonomy, similar to Ladakh and Leh Buddhist Autonomous Regions, under Article 244, read with the 6th and 8th Schedules of the Indian Constitution.


“Codavaland, often referred to as the Scotland of India, boasts a rich cultural heritage and strategic significance comparable to regions like Kashmir. The Codava community, indigenous to this land, has faced historical injustices and marginalization, akin to the plight of Kashmiri Pandits,” Mr  Nachappa stated. 


The memorandum highlights parallels between the struggles of Codavas and other indigenous groups worldwide, such as Tibetans and Balochs. It calls for constitutional protection of Codava identity and culture, emphasizing the community's contribution to the nation.


Furthermore, it underlines the failure of the executive and legislative branches to address Codava grievances, making a poignant appeal to the judiciary for relief. The memorandum underscores the judiciary's role in safeguarding constitutional rights and ensuring justice for marginalized communities.
